THIS DOCUMENT IS AN ELECTRONIC RECORD IN TERMS OF INFORMATION TECHNOLOGY ACT, 2000 AND RULES THEREUNDER.

Droveon ("Company" / "us", "we" or "our") provides technology-based services and acts as an intermediary for facilitating on-demand transportation services. By signing up or registering on the Platform and offering to provide one or more of the Services, you ("Driver Partner") acknowledge that you have read and understood these Terms and Conditions ("T&Cs") and agree to be bound by them without any limitation or qualification.

1. General Covenants & Relationship

  • Independent Contractor: The Driver will operate as, and have the status of, an independent contractor. The relationship between the Company and the Driver is on a principal-to-principal basis. The Company and the Driver are independent legal entities, and nothing here creates a partnership, employment, or agency relationship.
  • For the purposes of registration on the Platform, you conform that you are of legal driving age in India.
  • You are not restricted by any legal, regulatory, or judicial authority from providing Services.
  • By offering Services, you authorize Droveon to collect information to validate your identity including conducting police verification and background checks.

1.1 Eligibility & Registration

To register as a driver, you must:

  • Possess a valid Driving License, Aadhar Card, and PAN Card.
  • Provide valid vehicle documents (RC, Insurance Certificate, PUC Certificate).
  • Pass Droveon background verification and provide accurate, live selfie identity verification.
  • Have no pending legal proceedings regarding driving under the influence or any cognizable criminal offenses.

2. Driver Conduct & Execution of Services

In relation to the Platform, the Driver agrees to:

  • Not authorize others to use your Account or your Vehicle.
  • Follow all applicable traffic laws, speed limits, and safety regulations.
  • Maintain a dress code, hygiene, and professional demeanor as expected of a service provider.
  • Not consume alcohol, drugs, or illegal substances prior to or during the provision of Services. Droveon holds a strict zero-tolerance policy.
  • Not commit any fraud, including intentionally falsifying information, provoking users to cancel, claiming fraudulent fees, or using unauthorized mobile tracking overrides.
  • Ensure safety of passengers and packages at all times. Use of phone is prohibited while driving except in an emergency after safely parking.

3. Wallet, Service Fees & Payment Gateway

Drivers utilize the Droveon Wallet to manage their service earnings and platform commissions. Droveon uses verified Payment Gateways (e.g., PhonePe) to process wallet additions and payouts.

3.1 Inward Payments (Adding Money to Wallet)

  • Pre-paid Commissions: Drivers are required to maintain a positive wallet balance to accept ride requests.
  • Top-up Tiers: Drivers may use standard Quick Add options (e.g., ₹100, ₹200, ₹500) or enter a custom numeric amount via the dynamic input.
  • Gateway Restrictions: Transactions cannot be initiated without a valid minimum amount. Funds are credited instantly post-authorization via the payment gateway.

3.2 Outward Payments (Withdrawals)

  • Beneficiary Routes: Withdrawals are routed directly to the Driver's registered, verified bank account (Payout Destination).
  • Withdrawal Options: Drivers can withdraw the Full Balance or opt for Custom Amounts, leaving a baseline for platform functionality.
  • Processing Timelines: Withdrawal requests are processed securely within 2 to 24 business hours. Batching and limits (e.g., maximum free payouts per month) dictate operational payout costs.

4. Strict No-Refund & Cancellation Policy

All wallet top-up transactions, platform fee levies, and subscription charges processed through the Droveon App are FINAL, NON-REFUNDABLE, AND NON-CANCELLABLE.

  • No Refunds: Droveon explicitly does not provide refunds for any funds successfully loaded into the driver wallet via the Payment Gateway.
  • No Transaction Cancellations: Once a driver initiates a wallet top-up and the money is deducted from their respective bank account/card interface, the transaction cannot be cancelled or reversed under any circumstances.
  • Liquidation via Withdrawal Only: Any legitimately added funds remaining in the wallet can only be retrieved by completing an 'Outward Payment/Withdrawal' intent to your registered bank account, subject to standard 2-24 hour processing times. Refund requests to original payment methods (Cards/UPI) are outright denied.
  • Failed Transactions & Auto-Reversals: In the event of a technical or network failure where funds are debited from your bank account but not credited to the Droveon Wallet, it is treated as a pending or failed bank transaction. The respective Bank or Payment Gateway (e.g., PhonePe) will automatically process a reversal. The debited amount is typically refunded to the original payment source within 5 to 7 business days, as per standard banking guidelines. While Droveon will assist by providing the transaction status, the reversal timeline is entirely dependent on your bank.

5. Privacy Policy

By accessing the Driver App, you consent to our practices regarding data privacy, tailored specifically for transportation and delivery operations.

5.1 Data Collection

  • Personal & Identity Information: We store your name, age, contact details, Aadhar, PAN, Driving License, selfies, and vehicle registration data to ensure regulatory and safety compliance.
  • Location Data: Continuous background location data is fundamental to the platform. We collect this to assign rides, optimize routes, and track safety whenever you are "Online". Location polling halts when you mark yourself "Offline".
  • Financial Data: Bank account verification details are securely stored to facilitate timely payouts. Payment instruments and card details for top-ups are strictly handled by our partnered Payment Gateway (PhonePe) and are not stored on Droveon servers.

5.2 Data Usage & Security

  • Your information is used strictly to establish trust, manage payments, resolve driver-passenger disputes, and ensure the safety functionality of our marketplace.
  • We do not sell Driver Partner data to marketing third parties. Data may be shared with law enforcement or judicial bodies if subjected to any legal investigations.
  • All sensitive network traffic and transaction intents occur over PCI-DSS compliant secure protocols.

6. Jurisdiction & Proprietary Rights

All content on the Platform, including but not limited to designs, text, graphics, and interface logic, are the exclusive property of Droveon. Drivers are granted a limited, non-exclusive license strictly to provide Services. Any replication or reverse engineering is strictly prohibited. These terms are governed under Indian Law and dispute litigations shall be within local jurisdiction rules.
